The IADC will choose new leaders at our Annual Meeting in just a few short weeks. The IADC is very fortunate to have highly qualified and gifted leaders to consider for the President-Elect position. In addition, three of our members will be selected as new Board members. The IADC’s election process is both unique and uniquely fair when compared to that of other organizations and certainly other legal organizations. Let me explain. First, the sitting President submits to all candidates a list of potential members to serve on the Nominating Committee. The candidates have the right to object to any potential member of the Committee – with no limitation on the number of objections. From this vetted list, the President then chooses four members who are perceived to be fair and balanced and who will be open to the comments of to any member who comes before the Nominating Committee. The four members are led by an IADC Past President, who is four years removed from the presidency. This year, the Nominating Committee will be led by Past President Quentin Urquhart. Interestingly, all Nominating Committees take on their own personality, which is really a composite of the personalities of each of its members. The Past President does not direct the process, but rather offers guidance and identifies issues that should be considered by this unique Nominating Committee. Every organization of which I have been a part has allowed the Past Presidents to dominate the process. The unique IADC process does not allow this to occur. Rather, the IADC puts fresh leadership with new ideas at the forefront of our selection process. The other unique characteristic of the IADC’s nomination process is that the Nominating Committee will meet with any member who signs up to speak to them about any topic important to that member. Many people will meet with the Committee for the purpose of endorsing a particular candidate or providing names of recommended individuals to be considered for the Board, but others will meet with the committee simply to identify important issues for the IADC to consider. No matter how long you have been a part of the IADC, whether you’re a one or a twenty-five year member, your voice and your opinion matter to the Nominating Committee. To ensure full consideration of all candidates, we truly need to hear from you. Each election is important to the IADC, and this year is no different. We need full participation from everyone who is attending the Annual Meeting. If you are able to attend the Annual Meeting, please sign up for a time to speak your mind to our Nominating Committee. If you are unable to meet with the Nominating Committee and have an opinion to offer, please email your comments to the Nominating Committee Chair and copy our Executive Director, Mary Beth Kurzak (see page 9 for details). During my time with the IADC, I have spoken to the Nominating Committee numerous times. I shared my views as a relatively new member. I have supported particular candidates, and I have been interviewed as a candidate. I have also served on the Nominating Committee. With each encounter, I have been exposed to the energy, sober reflection, and critical thought of the Nominating Committee – reinforcing my belief that the IADC process is uniquely fair and equitable. Submit Comments for the Upcoming Board Elections
The Nominating Committee will receive comments at the Annual Meeting in Québec City, Québec Canada in July and then will nominate candidates to fill the following positions: President-Elect, Vice President of International, and three new Board members. Although the membership may elect any member to the President-Elect position, traditionally the membership has selected from the Board members who are completing their terms of office. There are five Board members leaving office this year. Board Member Jep Barbour has chosen not to be considered for the position. The other four outgoing Board members have expressed interest in the President-Elect position, and their biographies are offered on the next pages. Thank you to all five Board members for their impressive service and dedication to the IADC. We are very appreciative of all they have done. If you will be at the Annual Meeting, you can sign up for a time to offer comments to the Nominating Committee by going to the IADC Information Desk. Let Your Voice Be Heard!
Leta joined the IADC in 2003 and currently serves as the organization’s Secretary-Treasurer. Over the last fourteen years, Leta has thoroughly enjoyed being involved in every aspect of the IADC. She has served as Vice Chair and Chair of the Product Liability Committee; Vice Chair of the Drug, Device, and Biotechnology Committee; Chair of the Oregon State Membership Committee; and Regional Membership Chair. She has served as a member of the Membership, Investment, Open Forum, CLE Planning, and Audit Committees. In addition, Leta served as a member of the Defense Counsel Journal's Task Force and, for the last nine years, has served as a member of the DCJ’s Board of Editors. She has spoken at several IADC meetings and Webinars and written newsletters, journal articles, and other materials for various IADC publications. Leta has served as the host for four Regional Meetings in Portland, Oregon, and she and her husband Mark have been First Timer Hosts for numerous first time meeting attendees. Leta and Mark were honored to serve as Convention Chairs for the first international President and First Lady of the IADC, William (Bill) and Jane Perry. Leta was proud to serve as a faculty member of the 2010 Trial Academy. She was humbled to receive the Joan Fullam Irick Award in 2011 for her work on the IADC Product Liability Committee. Prior to being elected to the IADC Board of Directors, Leta served as a member of the IADC Foundation Board for four years. Before leaving the Foundation Board, Leta served as its Secretary-Treasurer. In addition to presently serving as Secretary-Treasurer, Leta currently serves as the liaison to the Alternative Dispute Resolution, Audit, and Investment Committees. She also serves as Chair of the Finance Committee. She remains active in the growth of the organization through her continued role as Regional Membership Chair and Membership Committee member. Leta continually looks for ways that the IADC can promote and support the needs of all of its members. She is thankful for the personal and professional opportunities the IADC has given to her, and she is constantly looking for ways to provide those same benefits to all members. In her spare time, Leta travels throughout the United States speaking to and encouraging young women to make healthy, safe, and responsible choices. She also volunteers for an international exchange student organization. Leta and Mark are members of the Foundation’s President Circle. They are givers and have hearts for international students as reflected in their “host parenting” of high school exchange students from Slovakia, Egypt, France, Austria, Russia, Norway, and Portugal. Leta is a Director at Betts Patterson & Mines in Portland, Oregon, where she specializes in product liability, complex commercial, and construction defect litigation. She was named one of Oregon’s Top 25 Women Oregon Super Lawyers in 2013 and, since 2011, she has been recognized by Best Lawyers in America and Oregon Super Lawyers. She has an AV® Preeminent™ Attorney Peer Review Rating and is included in the Bar Register of Preeminent Women Lawyers™ (Martindale-Hubbell®).

Emmanuèle Lutfalla is a partner in charge of the international department at her firm SOULIE & COSTE-FLORET, one of the top three niche firms in Paris specialising in product liability and insurance litigation. SOULIE & COSTE-FLORET is listed as a leading firm in Insurance and Reinsurance by Global Chambers 2017. Emmanuèle is listed in the International Who’s Who Product Liability Defence and in the International Who’s Who Insurance/Reinsurance. She holds a Masters degree summa cum laude in Business and Tax Law from Pantheon Assas (Paris) as well as a Masters degree in European Law from the University of Kent in Canterbury (GB). She was admitted to the Paris Bar in 1992 and worked at Clyde & Co and Norton Rose in Paris before joining SOULIE & COSTE-FLORET in 2003, where she became a partner. Her trial practice focuses on product liability, commercial litigation, and insurance litigation on a national and international basis. She has an extensive experience in handling complex litigation in cases involving nuclear plants, medical devices, automotive accidents involving multiple fatalities, serious injuries, and property damage. Emmanuèle joined the IADC in 2005 and since then has had the privilege of serving the organization and its members in many ways. She has spoken at major and internal CLE programs and has had publications in the Defense Counsel Journal and the International Committee Newsletters. After being a Vice Chair of Programs for the International Committee, she then became the Chair, setting up the first-ever task force for the recruitment of members in South America. In 2012, she received the Joan Fullam Irick Award in recognition of exceptional committee leadership. Also in 2012, she had the privilege of serving on the Nominating Committee. In 2013, she served as the Director of the International Corporate Counsel College in Paris. In 2013-2014, she became the Chair of the Continuing Legal Education Committee. In 2014, she chaired the First Timer program. She was elected to the Board in 2014 as Vice President of International. On the Board of Directors, she is the liaison to the Environmental and Energy Law Committee and the International Committee. She is also a member of the Membership Executive Committee and a member of the CLE Committee. With the help of the International Committee, she set up the first Regional Meeting in South America in 2015 and helped organise the Insurance Bermuda Triangle Event in Bermuda in 2016. She is a constant contributor to the IADC Foundation. This would not have been possible without the unconditional and loving support of her spouse, Yann, by far her better-half. Not to mention their son Antoine, born in 2004, 7 months before they attended their first IADC meeting. Antoine thinks the IADC is the best place he knows because of his trip to Hawaii! They also enjoy their three cats in Boulogne Billancourt where they live.

Eve is an AV® rated senior partner in the Labor and Employment Group of Breazeale, Sachse & Wilson, L.L.P. An active litigator for 35 years, she is involved in all aspects of dispute resolution and advice on a myriad of insurance, health law, and employment issues, and best practices. Defending both individual and class actions, Eve has tried numerous cases in state and federal court. Eve’s interest in the IADC began while attending meetings with her partner, Monica Frois. In 2003, Eve was nominated by Past President William Christovich for membership. Since that time, Eve has proudly served the IADC in numerous capacities. For the past three years, Eve has been a member of the Board of Directors, serving as the Board Liaison to the Diversity, Employment Law, Membership Executive, Membership, and Retention Committees, and the Yancey Memorial Award. She has fostered the IADC’s strategic efforts to increase and retain membership. Eve has been the Board Liaison to the Defense Counsel Journal Board of Editors for three years, and she is coordinating the publication this year of the Joan Fullam Irick Privacy Project V for President John T. Lay. Before joining the Board, Eve served on the Audit Committee (2011-2014) and on the 2013 Nominating Committee. Over the last 14 years, she has continuously worked on IADC programming through planning, presenting, and moderating Committee and Major CLE programs. She orchestrated the employment programming for the 2014 Corporate Counsel College. As the 2011 Midyear Meeting CLE Program Steering Committee Chair, Eve guided a successful meeting in Pebble Beach. Eve was also a member of two other Midyear CLE Program Steering Committees (2009-2010, 2014-2015) and the CLE Committee (2010-2011). Eve is a member of the Hospitality Committee and was a Convention Solos Program Co-Chair (2007-2008). Actively engaged in the Employment Law and Diversity Committees, Eve has served as Chair, in various Vice Chair roles, and has authored numerous newsletters and one DCJ article. She is a member of the Strategic Relations Task Force to advance diversity. Eve has been recognized in Chambers USA since 2008; Best Lawyers in America (2012-2017); Louisiana Super Lawyers (2013-2017); New Orleans Magazine Top Lawyer (2012, 2013, 2014, and 2016); Livewire Global Award (2015); New Orleans CityBusiness Leadership in Law Class (2008); and as a Woman of the Year (2003 and 2009). Eve and Monica have worn many hats over the years for the IADC. Together they have supported the Foundation at the President’s Circle level. They have hosted and organized dinners and social outings for new and international members at many Midyear and Annual Meetings. Monica currently serves as the Diversity Committee Chair, and she led the Book Review for the 2015 Midyear Meeting. She has also held Vice Chair positions for the Medical Defense and Health Law Committee, served on the General Convention Committee, and has been a First Timer Host. Eve and Monica are involved, active supporters of the IADC, committed to seeing the organization flourish. They enjoy being part of the IADC family.

Eve B. Masinter
Craig Thompson is a partner at Venable LLP, and his primary office is in Baltimore, Maryland. For several years, Craig chaired Venable's Diversity Committee, and is currently a member of the firm's Board of Directors. Craig concentrates his practice on product liability, mass tort, and other complex litigation matters. He has served as national trial counsel, coordinating counsel, and as a subject-matter team member for national and international corporations and manufacturers. Craig has been recognized in Chambers USA, The International Who's Who of Life Science Lawyers and The International Who's Who of Product Liability Defence Lawyers, the Best Lawyers in America, and the Legal 500 for Product Liability and Mass Tort Defense: Pharmaceuticals and Medical Devices. He is a member of the Product Liability Advisory Council, DRI, and an elected member of ABOTA. Craig earned two Bachelor of Arts degrees from the University of Maryland, College Park, and he currently serves as a member of the Board of Trustees of his alma mater. He earned his J.D. from the University of Maryland School of Law. Since joining the IADC in 2006, Craig has served the organization in a number of ways. He was a member of the Membership Committee, and remains involved with membership by serving as chair of his state membership committee. Craig has served as a speaker or moderator at various Midyear and Annual Meetings, Webinars, and at the Corporate Counsel College. Within the IADC, Craig has spoken or written about topics such as ethical considerations in the use of social media, implicit bias, preemption, e-Discovery, handling professional witnesses, and strategies for cross examining experts. Craig served on the IADC Nominating Committee in 2012. In 2013, Craig and his wife Deborah - also an IADC member - were First Timer Chairs for the Annual Meeting in Hawaii. Also in 2013, Craig was a member of the IADC Trial Academy Faculty and served with the amazing "Chuck's All-Stars." In 2014, Craig and Deborah proudly served as General Convention Chairs for Molly and Steven Craig for the meetings in Carlsbad, California and Vienna, Austria. They have both been consistent supporters of the IADC Foundation. Deborah has been a speaker at several IADC meetings, and she will serve as a member of the Trial Academy Faculty this year. Since being elected to the IADC Board in 2014, Craig has been Board Liaison for various Committees including Intellectual Property, Class Action and Multi Party Litigation, and Social Justice Pro Bono. He also serves as Board Liaison for the Strategic Alliance Task Force and the Think IADC First Task Force. He is a member of the International Long Range Planning Task Force, working with other board members to develop substantive membership strategies for international members. Craig and Deborah have three children under the age of fourteen, and their children have attended every Annual Meeting since 2007 except the 2012 meeting when daddy was on the Nominating Committee. The Thompson family has truly enjoyed serving the IADC, and would be honored to continue serving this wonderful organization.

The Nomination and Election Process The Nominating Committee is comprised of five IADC members. The Chair is the IADC President from four years prior. The current President appoints the remaining members of the Committee and identifies those individuals at the Opening Session of the Annual Meeting. Any member who has not been an officer or director or has served on the Nominating Committee in the past four years is eligible to serve on the Nominating Committee. The traditions of the IADC impose on the President the obligation to select active members who are aware of the activities of the organization and the responsibilities of leadership without selecting members who - by virtue of their level of activity - also enjoy a close personal relationship with one of the candidates. Qualification for Office Any active member in good standing shall be eligible for nomination and election to elective office, subject to any additional requirements for specific positions as outlined by the bylaws. No officer shall be eligible for re-election to the same office until no earlier than the fourth Annual Meeting after the conclusion after his or her term. Submitting Comments IADC members can submit comments to the Committee in advance of the Annual Meeting by email to Nominating Committee Chair Quentin F. Urquhart, Jr. (qurquhart@irwinllc.com), with copy to Mary Beth Kurzak, Executive Director (mkurzak@iadclaw.org). Members can offer comments in person at the Annual Meeting. (See page 9 for schedule.) Comments are limited to five-minute appointments at the Annual Meeting, so please come prepared to be efficient with your comments. Members can comment or express their opinion on each vacancy or candidate or just some. The Nominating Committee will be interested in not only in who you endorse but why, so please be prepared to elaborate on your recommendation. Prohibition of Campaigning The IADC's policy is to prohibit public or private campaigning for a position on the Board of Directors or as an Officer. Members are not to tell others that they are interested in serving on the Board. They may, however, if asked by members if they are interested in serving on the Board respond affirmatively. Members should not campaign on behalf of anyone whom they are supporting for a position on the Board or as an Officer. Candidates are not to ask for a commitment from any member of the Nomination Committee to support them. Elections The Nominating Committee will offer its slate of nominees at the Closing Session of the Annual Meeting. A voice vote shall be called for each nominee. Each member, other than those in Emeritus or Inactive status, shall have one vote and the majority vote of those members present and eligible to vote shall govern.

Per the IADC Bylaws, Secretary-Treasurer Leta Gorman is submitting notice of the following proposed Bylaws changes to the membership for consideration. These changes were recommended to the Board of Directors by the IADC Bylaws Task Force and approved for recommendation by the Board during its April Board meeting. The changes that are recommended to the membership are as follows: The first change provides a clarification in the wording related to the outside counsel requirements for membership. The change is intended to better address the types of civil defense law practiced by IADC members. It is as follows: Article III. Members. Section 1. Members. A. Any person who is and, for at least (8) eight years immediately prior to being nominated for Membership, has been licensed or otherwise authorized to practice law in any country, state or territory or other political subdivision duly authorized to administer justice in said jurisdiction, and is of high professional standing, who is whose practice is principally devoted to the representation of defendants, or business, management, or insurance interests in the formal legal dispute resolution of legal disputes or who represents and advances business interests before regulatory boards, governmental agencies, or in administrative proceedings; and who will contribute to the purposes and activities of the Association; provided, however, that service on the bench or as a public official engaged in the supervision or regulation of the insurance industry for all or any part of the eight (8) years immediately preceding a nomination for Membership shall satisfy, pro tanto, the foregoing experience requirements. To be eligible for membership it is expected that the individual would contribute to and promote the purposes and activities of the Association. The Board also reviewed language regarding the method of delivery for the final dues notice to those who have not renewed their membership. The Bylaws requires certified or registered mail and those means are not necessarily the most effective or cost efficient. The proposed Bylaws change to Article III. Members. Section 7.D. allows use of any physical mail or electronic communication that is trackable, which will allow staff to use the best current means to ensure that final notice is delivered to the non-renewing member. The change proposed is: Article III. Members. Section 7.D. Any Member who shall be in default in the payment of Dues by 90 days shall be promptly notified thereof by certified or registered mail or electronic communication that includes receipt of acceptance sent to such Member at the Member’s address contact information as shown on the Association’s records. Unless such Member shall pay such Dues within thirty days after such notification, the Member shall be automatically dropped from Membership in the Association. Persons whose Membership is terminated for nonpayment of Dues may apply in writing to the Board of Directors, which may refer the application to the regular Membership process or act on the application itself. Any person whose Membership had been terminated for nonpayment of Dues shall not become or be reinstated as a Member unless, in addition to other criteria of eligibility of Membership, he or she has paid a Reinstatement Fee to be determined by the Board of Directors. These Bylaws changes will be voted on by the membership present at the Opening Session on Monday, July 11 at the Annual Meeting in Quebec City. Professional Liability Roundtable Summary The Professional Liability Roundtable took place during the afternoon of May 18 at New York University School of Law in New York. The educational programming focused on social media and experts. The sessions were presented with panels that were interactive and informative. Mid-Atlantic Regional Meeting – Baltimore, Maryland USA – May 11, 2017 The Mid-Atlantic Regional Meeting held May 11 was a great success. Despite spring rains, more than 40 members and guests enjoyed a reception and tour at the Reginald F. Lewis Museum in downtown Baltimore. Museum tours were followed by remarks from Board Member Jep Barbour regarding the many ongoing IADC programs and events. Asian Regional Meeting – Singapore – May 25-26, 2017 On May 25 and 26, IADC members and guests from throughout Asia, as well as attendees from Russia, Austria, the Netherlands, Belgium, Australia, and the United States enjoyed two days of fellowship and timely educational programming at the IADC's Asian Regional Meeting in Singapore. From Asia, members and guests from Singapore, Malaysia, Thailand, Vietnam, China, South Korea, and Japan attended the event. Numerous corporate counsel members and guests also attended the event from Singapore. On May 25, attendees gathered at the brand new offices of Tan Kok Quan Partnership where our member Eddee Ng hosted our reception. Attendees were honored to enjoy a welcome address by Singapore's Permanent Secretary of the Ministry of Law, Mr. Ng How Yue followed by a meal at Otto in nearby Maxwell Chambers. On May 26, attendees enjoyed a full day of programing on regional topics of interests hosted at the offices of Rajah & Tann by our member Chuan Thye Tan. Attendees enjoyed the keynote address by Singapore Supreme Court Justice Belinda Ang as well as comments by the CEO of the Singapore International Arbitration Centre, Lim Seok-Hui. New Defense Counsel Journal Issue
Defense Counsel Training Manual Available in E-Reader Format
The Defense Counsel Journal is now being published solely in an open-access digital format. The Journal will no longer be offered in print, but rather in an online format that is easy to access and is searchable online. You can view and reach the Journal anytime, free of charge, without needing a login or password on its new home on the IADC website. You can find the Defense Counsel Journal under the "Publications & News" section of the IADC website. The Journal has the same high caliber of legal analysis in a new online format that makes it searchable and its resources and references more easily reachable. Volume 84, Number 2 is now online! First published in 1989 with a Second Edition to follow in 1994, the Defense Counsel Training Manual has become a staple reference piece for many throughout the years. The Manual is a collection of articles authored by some of the most experienced trial counsel and the 500+ pages include useful information and tips for trial lawyers handling every aspect of a case. IADC member Robert Kaler authored an article on avoiding international breach of construction contracts for Modern Contractor Solutions on behalf of the IADC. IADC President-Elect Andy Kopon, a founding member of Kopon Airdo LLC, won a case before the Seventh Circuit Court of Appeals in Chicago on behalf of Marian Catholic High School. Jamie Hood, a partner at Hood Law Firm LLC, obtained a defense verdict in a medical malpractice trial in Charleston County, South Carolina. IADC member Leigh Ann Schell joined the New Orleans office of Adams and Reese LLP as Special Counsel. IADC member Steven Smelser, a partner at Yukevich Cavanaugh, obtained a unanimous defense verdict on behalf of Ford Motor Company. IADC member Henry Sneath, of Picadio Sneath Miller & Norton, P.C., has been installed as an adjunct professor of law at Duquesne University School of Law. She also was awarded the Ellis Island Medal of Honor in early May. This award is given to a U.S. immigrant or native-born citizen who has made significant contributions to their local communities, the nation, or the world through their professional accomplishments. She was also named by the Daily Journal to their Top Women Lawyers in California list for the ninth year in a row. David Beck, a partner and co-founder of Beck Redden LLP, has been selected for inclusion in the inaugural Legal 500 U.S. Hall of Fame in the Dispute Resolution - Leading Trial Lawyers category. IADC member Carl Aveni authored an article for Litigation News, an American Bar Association publication, titled "Lawyers Sanctioned for Unilaterally Terminating Deposition." Doug McIntosh, President of McIntosh Sawran & Cartaya, P.A., spoke at the American College of Coverage and Extracontractual Counsel's Annual Meeting. Chris Lam, a partner at Bradley Arant Boult Cummings LLP, was named to new leadership positions with Mecklenburg County Bar (Vice President) and North Carolina Bar Association (Chair of Administration of Justice Committee).
